COMMON ORDER

(PER HON’BLE SMT. R.S. RAJESHREE, MEMBER, NON-JUDICIAL) 1. These appeals are filed U/s.41 of the Consumer Protection Act, 2019, by Opposite Party No.1 & 2 respectively being aggrieved by the order of the District Commission, Mahabubnagar, passed in CC No.26/2019 vide orders dated 06.01.2022. The District Commission had passed the following orders.

“In the result, the complaint is allowed partly, directing the Opposite Party No.1 & 2 jointly and severally to pay altogether Rs.1,00,000/- towards loss of earnings and mental agony sustained by the Complainant besides Rs.10,000/- towards costs of the proceedings to the Complainant within one month from the date of receipt of this order”.

As both these appeals have arisen out of one CC, both the appeals are being disposed of by way of a common order.

2. For the sake of convenience, the parties are described as complainant and opposite party as arrayed in the complaint.

The case of the complainant is that he had purchased a tractor model No.575BPO IBPS of Mahindra and Mahindra being a member of Ambedkar Rythu Mithra Sangham on 16.05.2018 from Opposite Party No.1 dealer. The engine number of the said tractor was ZJB3MAA 8825 and chasis No.MBNAAALBGJZB02785. That after receiving the delivery of the tractor that he had approached the District Transport Officer/RTO, Wanaparthy for getting the registration done. But, the RTO refused to register on the ground that the chassis number is not clear. The said fact was informed to Opposite Party No.1 upon which the Opposite Party No.2 had issued a letter dated 12.10.2018 to RTO, Wanaparthy stating that the non-visibility of the chassis number was not intentional and that the same has crept in at the manufacture level and also requested the RTO authorities confirming that the chassis number is same and authentic as mentioned in the delivery challan, as such, registration may be done.
