ORDER
Samiksha Bhattacharya, Member The instant complaint has been filed under Section 17(1) (a) (i) of Consumer Protection Act, 1986 against the OPs alleging deficiency in service.
Facts of the case in brief, are that the Complainants purchased 200 NSCs worth of Rs.5,000/- each which amounts to Rs.10,00,000/- and 30 NSCs of Rs.10,000/- each amounting to Rs.3,00,000/- totaling amount of Rs.13,00,000/-from Ballygunge Post Office/OP No.3 and the maturity amount was Rs.19,71,060/-. The maturity date of the certificates was 30.05.2018. Accordingly, the Complainant issued two cheques vide No.994195 and 004196 both dated 30.05.2013 drawn on State Bank of India towards purchasing the NSCs amounting to Rs.13,00,000/-. The Complainant also issued another cheque being no.627927 dated 30.05.2013 amounting to Rs.3,00,000/-. The Complainants transferred the NSCs to Sub-Post Office, Talpukur, District:North 24 Parganas/OP No.2 on 12.06.2013. On 30.05.2018 i.e. on the date of maturity the Complainants went to Talpukur Post Office/OP No.2 to withdraw the maturity amount where they came to know that the maturity date of those certificates has been changed to 21.09.2018 in Talpukur Post Office/OP No.2. The Complainants went to Post Office several times and requested to rectify the change in the maturity dates and prayed for interest for the delay in the payment of NSCs. Then the Complainant wrote a letter on 12.09.2018 to Senior Superintendent of Post, Barrackpore and the copy of the same was sent to Post Master, Ballygunge Post Office/OP No.3. But no fruitful result came. Then the Complainants lodged a complaint before the Consumer Affairs Department. But due to absence of Opposite Parties the matter was dropped. Due to the act of the Opposite Parties Complainants have not only suffered physically and mentally but also suffered monetary loss. Hence, the application praying for direction upon the Opposite Parties to refund the maturity amount of Rs.19,71,060/- alongwith 4% interest rate in the savings account in the Post Office till the date of realization alongwith compensation of Rs.4,00,000/- and litigation cost of Rs.30,000/-.
The Opposite Parties appeared before this Commission and contested the case by filing written version. The averments made in the complaint petition have not been denied by the Opposite Parties, but they have mentioned that due to migration the date of issue of the NSCs under the Registration No.13011 was shown in Finacle as 21.09.2013 i.e. date of transfer of certificates to Talpukur Post Office. Thus the maturity date was shown in the Finacle as 21.09.2018. The maturity date of other two Registration nos. being 13012 and 13013 was 12.06.2018 and 13.05.2018 respectively.
