Member - (Judicial).

1. This appeal is filed by the Appellant/Complainant U/s.41 of the Consumer Protection Act, 2019 praying this State Commission to set aside the orders of District Forum, Adilabad dt.15.12.2020 and allow the appeal as prayed for.

2. For the sake of convenience, the parties are referred to as arrayed in the complaint. The appellant herein were Complainant and Respondents was the opposite party in the complaint bearing No.CC 276/2018 before the District Forum Adilabad.

3. The brief case of the complainant is as follows:-

The complainant is wife of deceased Anga Rajanna, S/o.Muthaiah, Age:28 yrs, Occ: Coolie. On 21.11.2015 at about 05.00 hours complainant's husband Late.Anga Rajanna, S/o.Muthaiah, Age:28 yrs, Occ : Coolie was proceeding from Edula Bandam village to Nagampet village on bullock cart on way at out skirts of Edula Bandam village a live Electric wire fell on him and he electrocuted and died on the spot, the said incident occurred only due to negligence service of officials of addressee 1 to 4. On a complaint the Police of P.S.Kotapalli, registered the case in Cr.No.84/2015 under head of man missing later altered the section of law. Complainant's husband Late Rajanna, was hale and healthy, aged 28 yrs at the time of his death and used to earn Rs. 12,000/- per month by doing Coolie used to contributes his entire earnings on the welfare and benefits of complainant. But due to untimely death of complainant's husband the complainant suffered a lot physically, mentally and monetarily. The complainant issued legal notices to the Opposite Parties No.1 to 4 to pay the compensation of Rs. 15,00,000/-, the said notices served on them, but the Opposite Parties neither replied nor paid the compensation to the complainant.

Upon receipt of notice the Opposite Party No.2 filed counter. The Opposite Party No.1, 3 & 4 filed a memo to adopt the counter filed by Opposite Party No.2. The real facts are that some unknown persons hooked 11 KV line by means of binding wire for hunting wild animals to protect their fields at the outskirts of the village and this fact is known to the deceased and other villagers. The deceased knowingly came into contact with live binding wire and was electrocuted and died. There was no negligence, disservice or carelessness of the Opposite parties and their employees in maintaining the lines. The allegation of the complainant that the he deceased while proceeding from Edula Bandam village to Nagampet village on bullock cart and that on the way at outskirts of the Edula Bandam village, live electric wire fell on him and that on account of it the deceased was electrocuted and died are false and baseless and the same are created to claim compensation from the Opposite Parties. In fact at the relevant time no wire was snapped. The lines were intact. Standard materials are used for laying the lines. Routine checks of lines are made. The complainant has suppressed the real facts and set up a false story to claim compensation from the Opposite Parties.
