R.SUBBIAH J., PRESIDENT This appeal has been filed by the appellant/complainant, as against the order dated 02.02.2024, passed in C.C.No.174 of 2022 by the District Consumer Disputes Redressal Commission, Thiruvarur, dismissing the complaint filed by the appellant/complainant herein.

2. The appellant is the complainant and the respondents are the opposite parties. For the sake of convenience, the parties will be referred as per the rankings before the District Commission.

3. The case of the complainant before the District Commission is that on 01.06.2020, the complainant has availed a housing loan of Rs.31,12,664/- from the 1st and 2nd opposite parties bank under the Pradhan Mantri Awas Yojana (PMAY) Scheme by mortgaging her property. She was regularly paying the EMI without any default. Her Loan Account Number is 39319161754 and Loan Application Number is 19451911. Since the loan is based on MIG-I CLSS Scheme (Middle Income Group Credit Linked Subsidy Scheme), she is entitled for the subsidy amount of Rs.2,35,068/-. It is the responsibility of the 1st and 2nd opposite parties to get the subsidy from the Government of India by forwarding the complainant’s application for subsidy and the complainant is liable to pay interest only for the loan amount after deducting the subsidy amount. But, nothing was done by the 1st and 2nd opposite parties inspite of several letters sent by the complainant. Finally, on 01.09.2021, the 2nd opposite party sent a reply stating that the files regarding the subsidy was sent to the Sanction Office for further process. Thereafter, there was no update on this matter. When the complainant visited the website, namely, pmaymis.govt.in, her name was not found in the subsidy sanctioned list. The 1st and 2nd opposite parties have failed to forward her subsidy application to the Government of India. Hence, she sent a legal notice dated 27.10.2022 to the opposite parties, but there was no response from them. Hence, alleging deficiency of service, the complainant has filed the present complaint directing the opposite parties to pay a sum of Rs.5,00,000/- towards compensation for mental agony suffered by her.

4. The said case of the complainant was resisted by the 1st opposite party by filing a written version, which was adopted by the 2nd and 3rd opposite parties. The complainant has applied for a housing loan with subsidy benefits under Pradhan Mantri Awas Yojana Scheme on 24.03.2020. She was sanctioned Rs.30,00,000/- and on 17.06.2020, a sum of Rs.27,00,000/- was credited to her loan account as first instalment. At the
