Counsel for Respondents 2 to 4: Notice Served. Called absent This appeal came up for final hearing on 29.08.2025 and on hearing the arguments of the counsel for the Appellant /1st opposite Party and on perusing the material records, this Commission made the following:-

ORDER

R.SUBBIAH J., PRESIDENT This appeal has been filed by the 1st opposite party under Section 41 of the Consumer Protection Act, 2019, as against the order dated 21.10.2022 passed in CC.(RBT)No.58 of 2022, by the District Consumer Disputes Redressal Commission, Ariyalur, allowing the complaint filed by the 1st Respondent herein in part.

2. The Appellant is the 1st opposite party, the 1st Respondent is the complainant and the Respondents 2 to 4 are the opposite parties 2 to 4 before the District Commission. For the sake of convenience, the parties will be referred in the course of this order as per their respective rankings before the District Consumer Disputes Redressal Commission, Ariyalur.

3. The case of the Complainant before the District Commission is that, the 1st opposite party is engaged in the business of Housing Finance in the name of GIC Housing Finance Limited. The opposite parties 2 to 4 are the builders engaged in the business of construction in the name of R.R.P. Housing Private Limited. The opposite parties 2 to 4 made an advertisement stating that the 2nd opposite party (R.R.P) have formed Layout in the name of Amudham Homes at No.105, Nungambakkam Village, Tiruvallur Taluk and District and proposed to construct Low budget Villa in the said Layout. The complainant on seeing the said advertisement visited the Project site to verify the authentication of the project. The officials of the opposite parties 2 to 4 were present at the proposed construction site, took the complainant to the officials of the 1st opposite party GIC Housing Finance Limited and canvassed the complainant that the 2nd opposite party company project is having an approval from the 1st opposite party company. The 1st opposite party officials canvassed the complainant that they will immediately sanction loan to the purchaser of Villa, since the 1st opposite party Housing Finance Company already approved the above said project. The said officials also informed that since the 2nd opposite party (RRP Housing) had mutual understanding with the 1st opposite party Housing Finance Company, the housing loan for purchase of the said Villa will be sanctioned by the officials immediately. Further, the complainant was informed that the entire documents and building plan approval obtained from the concerned authorities for construction of independent Villa in the proposed Project site was verified by the legal department of the 1st opposite party Company. On the assurance made by the 1st opposite party officials, the complainant agreed to purchase one of the Villas proposed to be constructed in Amudham Homes from the
