For the Respondent: M/s. P.Kannan Kumar This appeal came up for final hearing on 12.09.2025, and after hearing the arguments and perusing the materials on record and having stood over for consideration till this day, this Commission passes the following:-

O R D E R

R.SUBBIAH J., PRESIDENT This appeal has been filed as against the order of dismissal dated

25.05.2023 passed in C.C.No.308 of 2022 by the District Consumer Disputes Redressal Commission, Chennai (South).

2. The Appellant is the Complainant, and the Respondent is the Opposite Party before the District Commission. For the sake of convenience, in the course of this order, the parties will be referred as per their respective rankings before the District Consumer Disputes Redressal Commission, Chennai (South).

3. The case of the complainant before the District Commission is that, the complainant is an Advocate. The complainant presented 5 Fixed Deposits Receipts with the opposite party for renewal. The opposite party informed the complainant that since the FDRs were presented one year after the maturity date the said FDRs could be renewed only with effect from the date of presentation and not with retrospective effect. The details of the F.D.Rs are as follows:-

5 A376334 12.04.2020 C302293 03.09.2021 50,000 The complainant sent a letter dated 25.01.2022, to the opposite party requesting to renew the aforesaid 5 FDRs with retrospective effect, for which there was no response from the opposite party. The complainant sent a similar letter to Manager, Fixed Deposits, Tamil Nadu Power Finance and Infrastructure Development Corporation Limited, Chennai-35, for renewal of FDRs filed one year after the date of maturity. For which the complainant received a reply stating that as per Clause 7(c) of the terms and conditions of TNPFC, in case the renewal application received/request made after three months from the date of maturity the same will be treated as fresh deposit and the interest rate prevailing on the date of receipt of application will be applicable. According to the complainant some banks like SBI have auto renewal facility and Finance Companies like Sundaram Finance and Sundaram Home Finance renew F.D.Rs presented even one year after maturity date. Hence, the present complaint has been filed for a direction to the opposite party to renew FDRs with retrospective effect crediting arrears of interest in the S.B. Account as furnished in the respective F.D.Rs from the date of maturity and also to pay compensation of Rs.2,00,000/- towards mental tension and agony and for costs.

4. The case of the complainant was resisted by the opposite party by filing a written version stating that, one Mr.P.Ramakrishnan along with his sister one Mrs. Sarada Ganga Rajah had made the following Fixed Deposits with the Tamil Nadu Transport Development Finance Corporation Limited.

The above FDRs had been matured in the respective dates mentioned above. Thereafter, the complainant submitted a letter dated 11.12.2018 informed the opposite party that Mrs.Sarada Ganga Raja, who is the sister of the complainant expired on 05
