Opposite Parties-Appellants-Haryana Urban Development Authority have filed the instant appeal under Section 41 of the Consumer Protection Act, 2019 for challenging the order dated 13.01.2023passed by the District Consumer Disputes Redressal Commission, Rewari whereby complaint filed by complainant-Satnarain Guptawas allowed observing:-

“Hence finding no merit in this complaint, we allow the same and set aside the speaking order, which is not a speaking order by any stretch of imagination. It is illegal, null and void and is not binding on the right of the complainant. the amount paid by the complainant to the tune of Rs.5,95,599/- on 10.06.2014 with OP-2 be refunded to him by OPs who are jointly and severally liable in the matter. The said amount to be refunded to him shall carry interest @ 9% per annum from the said date till realization within one month from today, failing which the said amount shall be paid to complainant, with interest @ 12% per annum simple from 10.06.2014 till payment. That apart we are inclined to grant compensation to the tune of Rs.50,000/- to the complainant, for mental and physical harassment. We also direct the OPs to pay to complainant litigation expenses to the tune of Rs.11,000/-. The said two amounts be also paid by OPs within one month from today, failing which same shall carry interest @ 9% per annum from the date of filing of the complaint till payment.”

The brief facts of the case as set out in the complaint are that opposite party No.1 had allotted a plot No.108 measuring 14 marla situated at Sector-3, Rewari in favour of Sh.BishanDayal S/o Sh.Omkar Mal R/o House No.2314 A, Nai Basti, Rewari,Tehsil and Distt. Rewari vide memo No.6002 dated 12.06.2002. On request of Sh.BishanDayal, the OP No.1 allowed transfer permission to Sh.BishanDayal vide letter dated 09.08.2002. The above said plot was re-allotted in favour of the complainant by the OP No.1 vide re-allotment letter dated 26.08.2002. On

30.09.2010, the OP issued possession certificate in favour of the complainant. All the dues were cleared by the complainant. The OP executed registered conveyance deed No.6440 dated 14.12.2010 in favour of the complainant. Prior of the execution of the conveyance deed, the complainant deposited the full and final payment of Rs.3,20,500/- dated 03.09.2010 as demanded by HUDA as per their accounts. The complainant failed to construct the house and hence, he has to deposit the extension fees from time to time with the OP. After execution of conveyance deed dated 14.12.2010, the complainant deposited sum of Rs.5057/- on 27.12.2013 and Rs.10,115/- on 10.02.2014 as extension charges.
