ORDER
R. SUBBIAH, J - President The appellant is the Complainant in C.C. No. 38 of 2022 on the file of the District Consumer Disputes Redressal Commission, Tiruvarur. The District Commission, by an order dated 23.09.2022, dismissed the Consumer Complaint, which prompted the appellant to file the instant appeal before this Appellate Commission.
2. Originally, the complainant filed a Consumer Complaint No. 35 of
2013 before the District Consumer Disputes Redressal Commission, Chennai (South). Subsequently, the Consumer Complaint stood transferred to the District Consumer Disputes Redressal Commission, Tiruvarur and was re-numbered as C.C. No. 38 of 2022.
3. The appellant claims that he and his family members are frequent flyers in British Airways as they regularly travel across the length and breadth of the World. For having undertaken frequent travel, the first and second Opposite Parties have also enrolled them under the Executive Club Membership of British Airways vide Membership Number 19442651. According to the complainant, he booked tickets through the third Opposite Party on 18.04.2012 to travel from Chennai (India to Quito (Ecuador) via London (UK) and Miami (USA) on 08th May 2012 in British Airways (MAA LHR MIAO) and American Airlines (MIA UIO) for himself and his family members. At the time of booking the tickets, for the journey on 08.05.2012, the third Opposite Party informed that as the computer reservation system was not allotting single PNR for the tickets of British Airways and connecting flight of American Airlines, different PNR numbers are being given. However, the third Opposite Party assured the complainant that issuing different PNR number will not be a matter of concern. According to the complainant, on 08.05.2012, he along with his family members went to Airport where they were shocked to learn that the British Airways Flight departing Chennai was cancelled and consequently, the complainant and his family members could not board the connecting flight to Miami, United States of America.
4. When the complainant caused enquiry, he was informed by the staff of the first and second Opposite Parties that they have rebooked the tickets for the complainant and his family members on Jet Airways to travel from Chennai to Mumbai, Mumbai to London and from London to Miami in British Airways on 09.05.2012. According to the complainant, he was totally shocked and upset when it was informed that the Opposite Parties 1 and 2 will not take any responsibility for re-scheduling the tickets in American Airlines Flight from Miami to Quito on 09.05.2020 by stating that American Airlines flights were not part of the ticket system of t
