Ramasubramaniam Associates This Consumer Complaint came up for final hearing on 13.10.2025 and upon hearing the arguments of the learned counsel for the Complainant, the learned counsel for the respondents 1 and 2 as well as the learned counsel for the third respondent and upon perusing the material records, this Commission made the following ORDER R. SUBBIAH, J - President This Consumer Complaint is filed by the Complainant invoking Section 17 of the Consumer Protection Act, for the following relief (s):-

(i) Direct the Opposite Parties jointly and severally to pay the Complainant the sum of Rs.40,00,000/- as consolidated compensation for selling the defective Car CIAZ 2018 Car and their deficiency of service in servicing CIAZ 2018 Car bearing Chassis No. MA3EXGL1S00377123, Engine No: K15BN1028727, Registration No. TN-13-R-4570 (ii) Direct the Opposite Parties to pay the costs

2. In the consumer Complaint filed by the Complainant, the complainant has stated as follows:-

(i) The first Opposite Party is an authorized Service Centre of the third Opposite Party, the second Opposite Party is the dealer and seller of the vehicle and the third Opposite Party is the Principal of 1st and 2nd Opposite Parties. According to the complainant, he approached the 2nd Opposite Party to purchase the CIAZ 2018 Car. At the time of such purchase, the 2nd Opposite Party assured the complainant that the CIAZ 2018 car would give mileage of 20 kilometer per litre. This was also stated in the website product specifications of the Opposite Parties. After satisfying with the product specification and the assurance of the 2nd Opposite Party that the Car will give a mileage of 20 kilometer per litre, the complainant purchased the Car bearing Registration No. TN 13 R 4570 on 28.03.2019 which was delivered to him on 08.05.2019 by the 2nd Opposite Party under invoice No. 014/VSL/18000943 for Rs.11,03,550/- which is inclusive of insurance and road tax. However, when the car was driven, the complainant was shocked to note that the Car did not give the assured fuel mileage. On the other hand, the Car had given erratic and very low mileage of 9 kilometer per litre. Further, two weeks after purchasing the car, the petitioner encountered malfunctioning of the power Steering with vehicle pulling to one side (either to left or right), accelerator pedal play and instrumentation panel/cluster lights malfunctioning. The complainant further states that when this was reported to the first respondent on 19.05.2019, the complainant was requested to bring the car for servicing. After sometime, the complainant was told that they made some adjustments to the electric power steering and it should now work properly. However, the steering problem did not resolve. That apart, the other complaints made by the complainant also were not resolved.

(ii) According to the complainant, on 24.05.2019 when he was travelling along with his family, he met with a minor accident adjoining the street where he lives. Therefore, the complainant once again reported the problem of vehicle pulling and other defects to the first Opposite Party’s ser
