1. These three consumer complaints arise out of a common transaction relating to booking of residential flats in a building project known as “Bhairav Darshan”, situated at Jagannath Bhatnagar Marg, near Elphinstone Road Railway Station (West), Mumbai. The complaints were originally instituted in the year 2001 by companies of the Libord group against M/s Shri Shiv Sai Construction Co., the developer of the said project, and the persons who were then managing and controlling the affairs of the project. The disputes pertain to alleged failure of the promoter to execute and register the agreements for sale and to deliver possession of the flats booked by the complainants.
2. The above referred three consumer complaints were filed independently but arose from the same project, the same course of dealings and substantially identical representations. Over the years the matters have travelled through multiple rounds of litigation before this Commission, the Hon’ble National Consumer Disputes Redressal Commission and the Hon’ble Supreme Court of India. Ultimately, by judgment dated 29.03.2023, the Hon’ble Supreme Court set aside the orders and returned the complaints to this Commission with a direction to decide them together on merits while continuing the order of status quo.
3. For clarity and to avoid repetitions we find it appropriate at the outset to indicate the correlation between the original complaint numbers, their present RBT numbers, the complainants and the flats involved in the project “Bhairav Darshan” as follows:

4. It is also pertinent to note that at the time of filing of the original consumer complaints in 2001 the only Opposite Party impleaded was M/s Shri Shiv Sai Construction Co., along with individuals described as its partners and/or persons managing and controlling the project. The grievances, as originally raised, were confined to the deficiency and unfair trade practices of the promoter and the persons in charge of the project in relation to receipt of booking amounts, non-execution of agreements for sale and non-delivery of possession and thus violation of the mandatory provisions of Maharashtra Ownership Act, 1963.
