The Appellant/Complainant has filed the present Appeal to challenge the impugned order dated 06.08.2024 passed by the District Consumer Disputes Redressal Commission, SAS Nagar, Mohali (in short, “the District Commission”), whereby the Complaint filed by the Complainant had been dismissed
2. It would be apposite to mention here that hereinafter the parties will be referred, as were arrayed before the District Commission.

Briefly, the facts of the case as made out by the Complainant in the Complaint filed before the District Commission are that the husband of the Complainant namely Sh.Sukhwinder Singh Sidhu had obtained housing loan vide Loan Account No.37566865729 from the OPs to purchase property/Flat No.D-3, Ground Floor, Block D, Casa Homes, Kharar, Landran Road, Sector 115, Mohali. Said home loan was got insured by the DLA. He had regularly paid the loan EMIs till 11.08.2020. Unfortunately, the insured DLA had expired on 14.08.2020. An intimation to this effect was given by the wife of the insured i.e. Complainant to the OPs vide letter dated 04.09.2020 with the prayer to recover the loan amount from the Insurance Company. The OPs had provided her a Copy of Loan Application, Copy of letter of arrangement, Copy of Loan Agreement and Copy of Sanction letter. In the Application Form it was clearly mentioned that the husband of the Complainant had opted for SBI Life Rinn Raksha Policy. Said policy coverage was for any eventuality of death/disability. The intent to obtain the policy was to protect his dependents from the liability of outstanding loan. One time premium was to be paid for the same. Even in the letter of Agreement dated 05.03.2018 the loan amount was mentioned as Rs.28,09,000/- + Rs.31,000/-, totaling to Rs.28,40,000/-. Accordingly, equated monthly installment of Rs.36,593/- was calculated by the Bank commencing w.e.f. 10.04.2018. The installment for the said loan inclusive of Insurance Cover was paid by the husband of the Complainant till his death. The Complainant had sent the email dated 07.09.2020 to follow up the settlement of Insurance Claim with OPs. She had sent several reminders for recovery of balance loan amount from the Insurance Company. However, no relief was provided by the OPs. They had rejected her claim vide email dated 10.09.2020 wherein it was mentioned that no Insurance Policy vide SBI Life Rinn Raksha Policy was done at the time of loan disbursement.
