O R D E R

1. Delay of 13 days in filing the appeal is condoned for the reasons stated in the application for condonation of delay.
2. Opposite Party No.1-Appellant-ICICI Prudential Life Insurance Company Ltd., has filed the instant appeal under Section 15 of the Consumer Protection Act, 1986 for challenging the order dated 23.10.2017 passed by learned District Consumer Disputes Redressal Forum, Panipat whereby complaint filed by complainant-Raman Sharmawas allowed with directions:-
“11. Xxxx Therefore, the OP No.1 shall pay the entire loan dues including interest etc. to the OP No.2 to 4 outstanding against the loan account of the deceased life assured Smt. Parveen Sharma, with the OP No.2 to 4.
12. So as a result of our aforementioned findings and observations, we accept the present complaint in the manner discussed above in para No.11 of this order, and direct the OP No.1 to make the compliance of this order within a period of thirty days from the date of receipt of the copy of this order. The complainant shall also be entitled for a sum of Rs.5500/- for the litigation expenses.”

The brief facts of the case are that the complainant’s mother availed loan to the tune of Rs.2,00,000/-, top-up loan of Rs.5,00,000/- lacs and home loan of Rs.4,40,000/- from Opposite Parties No.2 to 4 against mortgage of House No.51 situated at Veer Bhawan Chowk, Panipat. At the time of obtaining the said loan, complainant’s mother obtained an ICICI Prudential policy from the OP No.1 i.e. Loan Protect FP Mortgage policy No.19126572 dated 31.01.2015 for five years policy term against the said loan of Rs.11,40,000/- with premium of Rs.15823/- per year.
The policy was got issued through OP Nos.2 to 4 with assurance that in case of death of policy holder i.e. said Smt. Parveen Sharma or loan account holder, the respondent No.1 directly would pay the outstanding amount to respondents No.2 to 4. Co
