JUDGMENT

1. The present complaint has been filed by the Complainant before this

commission alleging deficiency of service on the part of the Opposite Parties

and has prayed the following reliefs:

i. “To order the respondent to pay to the complainant a sum of Rs

1,22,55,873/- along with interest @ 12% immediately from the

date of payment done by the complainant, till its payment by the

respondent.

ii.The Respondent be further ordered to pay to the Complainant

damages to the tune of Rs. 20,00,000/- (Rs. Twently Lacs Only)

for the harassment and mental torture caused to the Complainant.

iii.Cost of the present complaint may also be awarded.

iv.Any other or further relief which this Hon’ble State Commission

deems fit & proper under the circumstances of the case may also

be awarded.”

2. Brief facts necessary for the adjudication of the present complaint are that the

Complainant vide application dated 09.05.2019, applied online for a MIG flat

under the DDA Housing Scheme 2019 pursuant to an advertisement issued by

Opposite Party No. 1 (DDA) and paid a booking amount of Rs. 2,00,000/-.

Further, a MIG flat was allotted to the Complainant through a draw held on

23.07.2019. Thereafter, DDA issued a demand-cum-allotment letter dated

20.09.2019 for Flat No. 1, 5th Floor, Pocket-1A, Block B-5, Sector A1-4,

Narela, measuring 112.77 sq. m., demanding the balance amount of

Rs.93,87,762/- on or before 19.12.2019. In compliance, the Complainant paid

the entire consideration amount of Rs.96,83,841/- (after adjustment of

application money and TDS) on 16.12.2019, partly through a housing loan

and partly from personal savings. Despite full payment, possession of the flat

was not handed over within the stipulated time. Although the process was

meant to be entirely online, due to technical issues in DDA’s system, the

Complainant submitted the requisite documents physically at the DDA office

on 10.02.2021 as advised by DDA officials.

3. Even after completion of all formalities, the Complainant was repeatedly

denied possession and was compelled to make continuous follow-ups. In June

2020, DDA officials unexpectedly claimed that necessary documents had not

been submitted and thereafter raised multiple and inconsistent demands for

documents, many of which had already been furnished earlier. The

Complainant submitted documents repeatedly, both in person and through

email, and sent several reminders between June 2020 and November 2020,

including representations to higher authorities such as the Lieutenant

Governor of Delhi, Chairman DDA, and Vice Chairman DDA. Despite

acknowledgements from various senior officers, no effective action was
