O R D E R

(Passed On 31.12.2025)

Per Say Justice Sunita Yadav, President:

Aforesaid appeals arise out of the order dated 27.01.2014 passed by the

District Consumer Disputes Redressal Commission, Jhabua (for short ‘District

Commission) in C.C. No. 51/2012 whereby the complaint filed the

complainants/respondent no. 1 to 3 has been allowed. Since both appeals arise out

of the same order, therefore they are taken up together and are being disposed of

by this common order. For convenience facts are taken from Appeal No. 474/2014

unless otherwise stated.

2. Facts of the case in short are that the complainants in the year 2008

under the R.E.G.P scheme of the opposite party no.2-Khadi Gramoudyog for

establishment of unit for manufacturing Dona Pattal got sanctioned a loan of

Rs.9,50,000/- and executed the documents in favour of opposite parties on which

30% amount was to be given as subsidy. For

the security of loan they mortgaged FDRs of Rs.6,00,000/-. After completion of all

formalities, the complainants took Nanka's land situated at Village-Gelarbadi and

started the unit for manufacturing Dona Pattal. The complainants were also giving

training to other beneficiaries and the complainants were made available subsidy

amount of Rs.2,99,400/- but the opposite party no.1-bank with malicious intent in

order to cause financial loss to the complainant inspected the premises and

prepared a false report and got the subsidy amount returned and the rest amount

was adjusted from the FDRs due to which the complainants suffered loss, which

amounts to deficiency in service. The complainants therefore filed a complaint

before the District Commisio seeking relief of subsidy amount with interest

Rs.3,85,333/- along with compensation and costs.

3. The opposite party no.1-bank in their reply to the complaint before the

District Commission submitted on 08.02.2008 loan was sanctioned under different

head
