1. This appeal is filed by the Complainant U/s.41 of Consumer Protection Act, 2019 aggrieved by the orders of the District Consumer Disputes Redressal Commission, Ranga Reddy in CC.No.51/2017 dated 20.10.2020 for dismissing the complaint filed by him.

2. For the sake of convenience, the parties are hereinafter referred as arrayed in the complaint.

The complaint pertains to deficiency in service of the Opposite Parties in not completing the arrangements and other amenities assured to be provided for the residential gated community by name “Yashoda Sannidhi” situated at Survey Nos.20 & 28/1 of Miyapur Village, Serilingampally Mandal, GHMC Serilingampally Circle, Ranga Reddy District.

4. The case of the Complainant in brief was that:

a) The Opposite Party No.3 entered into Development Agreement cum General Power of Attorney with developer M/s.Yashoda Builders & Developers (Opposite Parties No.1 & 2) to complete residential complex known as “Yashoda Sannidhi” in a total land of 6479.92 square yards. The Opposite Parties made the Complainant believe that the project was their brain child and exclusively for the people who were aspiring a secured and friendly life style and the same was assured in their speeches and brochures of “Yashoda Sannidhi” and in their advertisements. The Opposite Parties assured that in the residential building complex they would build a spacious healthy Gym, Children‟s play area, Community Hall, Convenient Stores, CCTV Surveillance Security, Piped Gas, Sewerage Treatment Plant, Lush land scape, yoga meditation hall, water softening system, 3 lifts of 8 passengers capacity and parking area.

b) The Complainant submitted that he purchased Flat No.409 in A-Block of 4th Floor admeasuring 1006 square feet and one car parking area of 80 square feet along with 34 square yards of undivided share of land out of the total land admeasuring 6479.92 square yards or equivalent to 5418 square meters vide Agreement of Sale dated 21.08.2013 and Sale Deed document No.14109/13 dated 19.09.2013. The Opposite Parties collected an amount of Rs.26,55,600/- i.e., an amount of Rs.18,50,800/- towards the purchase of flat and the balance amount for providing facilities which they have said in the brochure. The Complainant further submitted that the Opposite Parties have not provided the amenities which they have stated in the brochure and advertisements. They arranged two lifts
