3. The brief facts of the case are that complainant applied for domestic electricity connection vide application No.Y36-618, dated 22.06.2018 in her name by completing all the formalities. Area incharge of OPs visited the site and submitted his report that defaulting amount is outstanding against her father-in- law. On the basis of said report, OPs refused to release electricity connection in favour of complainant. The premise of the complainant is far away from the premises of her father-in-law. Complainant requested many times to OPs to release the electricity connection, but OPs refused the same.
4. Upon notice, OP raised its contest and admitted that complainant applied for domestic electricity connection. After verification of record, it came to the notice that earlier an electricity connection was installed in the said premises in the name of father-in-law of complainant against which Rs.63,509/- is outstanding. As per clause 21-A (B) of Sale Circular No.U-03/2013 re-connection or new connection is not permissible in the same premises qua which previous arrears are outstanding. The electricity connection of the complainant shall not be released till the default amount is not cleared. There is no deficiency in service on the part of OP.
5. Complainant led her evidence. On analyzing the same; learned District Consumer Commission, Yamuna Nagar at Jagadhri has allowed the complaint vide impugned order dated 19.03.2019, which is as under:-
