This order will dispose of aforementioned two appeals bearing No. A/268 of

2025 titled as Om Prakash Versus Dr.Rameshwari Sharma and appeal No.A/285 of 2025

titled as Dr.Rameshwari Sharma Versus Om Prakash both arising out of one and the

common order dated 22.07.2025 passed by the District Consumer Disputes Redressal

Forum-I, U.T. Chandigarh whereby complaint of the complainant-Dr.Rameshwari Sharma

bearing No.677 of 2022 was partly allowed and the Opposite Party was directed as

under:-

(i) To refund Rs.1,00,000/- to the Complainant being the excess amount

pai with interest @9% p.a. from the date of filing the complaint

onwards.

(ii) To pay Rs.20,000/- to the complainant towards compensation for

mental agony, inconvenience, deficiency in service, unfair trade

practice and for loss of use of property;

(iii) To pay Rs.10,000/- as litigation expenses;

This order be complied with by the Opposite Party within 45 days

from the date of receipt of its certified copy, failing which, the amount(s)

mentioned at Sr.No.(i) & (ii) above shall carry penal interest @ 12% per

annum (simple) from the date of expiry of said period of 45 days, instead

of 9% [mentioned at Sr.No.(i) above], till realization apart from payment

of litigation costs..

2. The facts are being culled out from appeal No.268 of 2025 titled as Om Prakash

Versus Dr.Rameshwari Sharma;

Before the Ld. Lower Commission, it was the case of the Complainant

(Appellant herein) that she came in contact with the Respondent/Opposite Party while

he was working on house renovation in her neighborhood. The Opposite Party

discussed with the complainant that the total consideration amount shall be

Rs.9,50,000/- for renovation of her complete house including furniture, raw material,

tiles, labour charges etc. and the same was written by the said Om Prakash in his own

handwriting and
