JUDGMENT

1. The present Complaint has been filed by the Complainant before this Commission alleging deficiency of service and unfair trade practice by the Opposite Parties and has prayed the following:

A) Complete loss on account of fire in the house. = Rs.14, 81,450.00 B) Cost of Repairs/Restoration/Renovation etc. = Rs. 13,70, 000.00 C) Rental Charges for 6 months @ Rs. 14000/-PM = Rs. 84, 000.00 D) Inspection/Survey Charge of the Govt. approved.

Valuer = Rs.10,000.00 Sub total = Rs.29,45,450.00 E) Interest @ 24% PA from 16-09-2014 to 29-02-2016 = Rs. 10,30,908.00 F) Mental Agony, Torture, Humiliation & Humiliation = Rs. 2,00,000.00 G) Expenses of the Petition and Legal Expenses = Rs. 50,000.00 Grand total = Rs. 42,26,308.00

2. Brief facts necessary for the adjudication of the present Complaint are that on

30.04.2013 a fire broke out at about 4:30 p.m in the house of the Complainant due to sudden blast of the LPG Cylinder supplied by the Opposite Party no.1 in the residential premises of the Complainant at D-3/13 Sector-11, Rohini, Delhi-110005. The impact of the blast was so heavy that the sound was heard in the surrounding residential area and within no time and the fire engulfed both, first and second floors of the building, and all belongings of the family were reduced to ashes in no time. The Complainant after recovery from trauma and shock immediately approached Opposite Party No. 1 to process the insurance claim for the alleged loss due to the fire, but despite several follow-ups to the Area Office of the Opposite Party no.2, both in person also on telephones, no fruitful result was obtained. Lastly on 03.07.2013 the Complainant served a letter upon Opposite Party No.1 personally, along with all reports of the losses suffered by the Complainant, to get the insurance claim processed, followed by a reminder dated

22.07.2014 by registered post to the Opposite Parties but all in vain.

3. It is submitted that the Opposite Party No.1 treated the Complainant with contempt and failed to help the Complainant in getting the Insurance Claim processed. It is further submitted that the Opposite Party No.2 did not help the Complainant despite multiple requests made by the Complainant telephonically and in writing. Secondly, it is submitted that the Opposite Party No.3 is liable to compensate the damages suffered by the Complainant on account of the bursting of the gas cylinder. Thirdly, it is submitted that the Opposite Parties have intentionally and deliberately not settled the Claim of the Complainant and
