1. This appeal is filed by the complainant u/s 41 of the Consumer Protection Act, 2019, aggrieved by the orders passed in CC 33/2019 by the District Consumer Disputes Redressal Commission, Adilabad, dated 25.04.2022 for dismissing the complaint filed by him.
2. The parties are herein after referred to as they were arrayed before the District Commission, as complainant and opposite parties.
3. The case of the complainant in brief was that he was having electricity power supply connection to the meter bearing No.61411- 01259. The said mulgi was consisting of a small room with one fan and one CFL bulb of 14 watts. The opposite parties No.1 to 3 installed meter service connection No.01259 in the year 2016 for category-II. The complainant was paying the electricity bill every month regularly without any interruption, as per the bills issued by the opposite parties from the date of installation of the meter till the date of disconnection of the meter. On 14.02.2018, the complainant received monthly electricity consumption bill for an amount of Rs.185/- plus arrears of Rs.41,602.91ps., in total for an amount of Rs.41,787.91 ps. The complainant was shocked to receive the bill and went to the office of opposite party No.1 and had shown the excess bill and also submitted all monthly bills paid by him to the opposite party No.1. On 25.08.2018, the opposite party No.1 disconnected the said service connection without giving any notice to the complainant. Then the complainant went to the office of opposite party No.1 and requested to correct the clerical error in the bill. The opposite party No.1 stated that they would adjust the bill within 15 days but till date they had not corrected the defective bill. The request of the complainant to restore the service was delayed. Since, the date of disconnection, the opposite party No.1 had not corrected the bill on the basis of electricity load used by the complainant to his house. The acts of the opposite parties were illegal, arbitrary, against the principles of natural justice and amounts to deficiency of service. The Linemen of the area would visit every month and note down the meter reading. If he found any wrong or defects committed by the complainant, he would have brought it to the notice of the opposite party No.1 immediately and prayed to declare the bill of Rs.41,787.91ps as null and void and to restore the electricity service connection No. 61411-01259 to the complainant’s mulgi, bearing No.6-56, Main Road, Jainoor Village & Mandal, Asifabad (Kumarambheem) and to direct the opposite party No.1 to receive the monthly bill from 25.08.2018 till date and to pay a compensation of Rs.10,000/-
towards pain, suffering and mental agony and to award costs.
4. The opposite party No.1 filed written version admitting that the service connection No.61411-01259 was released to the mulgi belonging to the complainant at Jainoor Village & Mandal.
