1. This Revision Petition is filed by the Petitioner/Opposite Party No.3 aggrieved by the order dated 11.09.2025 in IA.No.180 of 2025 in CC.No.512 of 2022 passed by the District Consumer Disputes Redressal Commission-I, Hyderabad in dismissing the petition filed by them to refer the case record to expert Neurosurgeon of any Government Medical College and Hospital.

The Respondents No.1 to 3 are the Complainants.

2. For the sake of convenience, the parties are described as arrayed in the complaint.

3. The Complainants filed a complaint of medical negligence against the Opposite Parties No.1 to 5 to pay an amount of Rs.3,10,000/- towards medical expenses paid by them to Opposite Parties No.1 to 5 and funeral expenses incurred by the Complainant, to award compensation of Rs.1 Crore and to pass such other orders as deemed fit. The Opposite Parties No.1 to 5 filed a written version. During the course of enquiry, the Complainant No.2 was examined as PW1. When the matter was coming for the further evidence of the Complainant, they filed IA.No.218/2023 to appoint an expert. The said petition was allowed by the District Commission on 16.08.2023. Thereafter, an expert doctor was examined by the Complainants and he was also cross examined by the learned counsel for Opposite Parties No.1 to 5 as per the orders in RP.No.2/2024 dated 15.03.2024. Subsequently, the Opposite Parties also adduced their evidence and the matter was posted for arguments. At that stage the Opposite Parties No.1 to 5 filed IA.No.180/2025 to refer the matter to an expert Neurosurgeon of any Government Medical College and Hospital. The Respondents/Complainants resisted the petition by filing their counters. The District Commission after hearing the counsel on both sides and on considering the material on record, dismissed the said petition.

4. Aggrieved by the dismissal of IA.No.180/2025, the Opposite Party No.3 preferred this revision.
