With Ms.Renu Dhir, In person HARINDERPAL SINGH MAHAL, PRESIDING JUDICIAL MEMBER This appeal has been preferred by the appellant/complainant- Mrs.Renu Dhir against the order dated 28.10.2025 passed by District Consumer Disputes Redressal Commission, Jalandhar (in short ‘District Commission’), whereby the complaint filed by the complainant under the Consumer Protection Act (in short ‘the Act’) was dismissed.
It would be apposite to mention that hereinafter the parties will be referred, as have been arrayed before the District Commission.

This appeal has been preferred by the appellant/complainant along with an application IA No.180 of 2026 under Section 5 of the Limitation Act for condonation of delay of 45 days in filing the appeal on the ground that the certified copy of the order was received by the complainant on 11.11.2025. Thereafter, initially the appeal was electronically filed on 16.12.2025, vide reference No.202512160024. The appellant was under the bona fide belief that no further action was required unless specifically directed, as no clear remarks or instructions regarding submission of physical copies within a stipulated time were reflected on E- Jagriti Portal. The case status was reverted and again updated on the E-Jagriti Portal on 20.01.2026, without any date or direction regarding submission of physical copies. It is submitted that due to lack of knowledge and absence of clear instructions, the appellant could not submit the physical copies within time. Due to the above circumstances, a delay of 45 days occurred in filing the appeal, which is neither intentional nor willful. It is prayed for condoning the appeal.

Briefly stated facts of the complaint are that the earlier complaint was filed seeking compensation on the ground that the name of the complainant was not included in the records of the Society despite the order dated 30.10.2019 passed by Ms. Amita Singh, Civil Judge, Jalandhar, due to which the complainant claims to have suffered loss. It is relevant to mention that the complainant had earlier filed a complaint on 22.04.2025, which was decided on 14.05.2025. The Commission had observed that the complaint was not maintainable as contempt proceedings regarding the same issue were already pending before the Civil Court. It was also noted that Sh. Anil Kumar Dhir was not authorised to file the earlier complaint. The complaint was filed by Mrs. Renu Dhir. The Civil Court, vide order dated 30.10.2019, had held that the applicant/complainant, being the purchaser of the share of Sh.Shivender Singh, was entitled to transfer of membership of the property in her name or in the name of her nominee. However, the property was not transferred in the name of Mrs.Renu Dhir. Subsequently, the complainant filed a contempt petition before the Civil Court. In the said proceedings, Sh. Gagandeep Singh Garg, Civil Judge (Sr. Division), vide order dated 11.04.2023, directed the applicant/complainant to file an application before the Executive Committee of the Society for recording the name of Renu Dhir in the society records.
