Consumer Complaint No. 09/2019
For the Appellants/Petitioners: Anil Asalia
For the Respondents: S.C. Tilawat
An insurer cannot repudiate a claim for fire loss based on alleged lack of regulatory licenses if those licenses were not critical policy conditions, were not required for the specific business activities disclosed, and were never objected to during the inspection and prior renewal of the insurance policy.
Headnote:(A) Consumer Protection Act, 1986 - Section 17(1)(a)(i) - Consumer dispute regarding repudiation of insurance claim for fire loss - Insurance company justified the closure of the claim file based on lack of requisite licenses and registrations for storing chemicals - Court held that the policy was issued after inspecting the premises and was subject to continuous renewal without objections regarding the nature of the unit - Evidence showed the unit was a mixing and repacking facility, not an industrial processing unit requiring the industrial licenses sought by the insurer - Survey report confirmed the genuineness of the loss and the extent of damage - Repudiation of claim without establishing breach of fundamental policy conditions or statutory violations is unjustified. (Paras 9, 10, 13, 23, 27, 28)
(B) Evidence - Res ipsa loquitur - Doctrine inapplicable where the cause and circumstances of the loss were clearly established and verified by the surveyor as genuine - Adverse presumption cannot be drawn against the insured based on pending criminal proceedings if the same do not relate to breach of fundamental conditions of insurance policy. (Paras 10, 23)
Facts of the case:
A partnership firm took an insurance policy for its factory and stock. Significant fire damage occurred, destroying the building and inventory. The insurer appointed a surveyor, but subsequently repudiated the claim based on the insured's alleged failure to hold specific industrial and safety licenses and registrations. The insured challenged this, arguing the documentation requested was unnecessary for their specific business activity, which was limited to mixing and repacking chemicals.
Findings of Court:
The court found that the insurer had inspected the premises before issuing the policy and had renewed it several times, implying acceptance of the risk. The insurer failed to prove that the activity conducted required the specific licenses it demanded or that the insured violated fundamental disclosure requirements. The survey report quantified the loss, and the court accepted this assessment, awarding compensation along with interest, finding no merit in the insurance company's refusal to honor the legitimate claim.
Issues: The central issues were the validity of the insurer's repudiation based on lack of specific industrial licenses and whether the insured's failure to provide such documents constituted a breach of the insurance policy conditions.
Ratio Decidendi: Insurance companies cannot repudiate a claim based on alleged regulatory non-compliance of the insured that was not a fundamental condition of the policy and was not raised during the inspection and renewal of the contract of insurance. The duty to indemnify arises once the loss is proven to be genuine and directly linked to the insured event.
Result: Appeal allowed in part; insurer directed to pay the assessed loss amount with interest and compensation for mental agony.
