An insurance claim for vehicle theft cannot be totally rejected for minor policy breaches if the theft is verified. In such cases, a non-standard settlement, typically amounting to 80% of the Insured Declared Value, is considered a fair and legally sound approach.
Headnote:(A) Consumer Protection Act - Insurance Claim - Standard of proof for theft - Repudiation by insurer on the ground of breach of policy conditions regarding safe parking and delayed information - Where FIR is lodged promptly, insurance company cannot reject claim merely on grounds of slight delay in information, especially when theft is established through investigation. (Paras 8, 12, 13)
(B) Quantum of Compensation - Non-standard claim - Where there is contributory negligence or lapse in policy conditions, but the factum of theft is proven, an award of 80% of the Insured Declared Value (IDV) is legally permissible and equitable. (Paras 13, 14, 15)
Facts of the case:
The complainant purchased a vehicle insurance policy. The vehicle was stolen from a residential parking area. An FIR was registered immediately. The insurance company repudiated the claim citing breach of policy conditions asserting that the vehicle was left insecure and that two unique original keys were not provided. The District Consumer Commission partially allowed the complaint, awarding 80% of the claim, which was challenged by the insurer in appeal.
Findings of Court:
The court observed that the FIR was prompt and theft was verified by the investigation report. The allegation of insecure parking was rejected as the vehicle was kept in private residential parking. Regarding the keys, the court reasoned that while the loss of one key justified a deduction, it did not warrant total rejection of the claim, thus upholding the 80% payout methodology.
Issues: Whether the repudiation of the insurance claim by the insurer was justified due to alleged breach of policy terms concerning vehicle security and key management; and whether the calculation of the compensation amount by the lower forum was accurate.
Ratio Decidendi: When a theft claim is supported by a prompt police report and investigation confirming the incident, a minor breach of policy conditions such as security measures or key production does not justify total repudiation. A proportionate deduction (non-standard settlement) is appropriate to balance the insurance contract obligations.
Result: Appeal partly allowed; lower court award modified to 80% of the correct IDV.

1. Oriental Insurance Company Limited Vs. K.K. Valsalan - Revision Petition No. 4521/2013, decided on- 07-05-2014
2. Paramjit Kaur Vs. Oriental Insurance Company Limited - Revision Petition No. 650/2014, decided on- 29-05-2014
