STATE CONSUMER DISPUTES REDRESSAL COMMISSION HARYANA

HAFED COLD STORE – Respondent
FIRST APPEAL NO. SC/6/A/980/2019|First Appeal No. 14 of 2019|First Appeal No. 980 of 2019

For the Respondents: Pardeep Panwar, Bhupinder Singh

The burden of proof regarding the maintenance of required temperatures in a cold storage facility lies with the service provider; failure to provide evidence of temperature maintenance constitutes a deficiency in service.

Headnote:The matter pertains to the Consumer Protection Act, 1986/2019. A complainant stored 400 bags of potato seeds in a cold storage facility, which were later found to have sprouted to the extent of 60% to 65%, rendering them unfit for sowing. The District Commission allowed the complaint, awarding compensation for the loss of seeds and mental agony, noting a deficiency in service. The service provider contended that the loss was not due to their fault and relied on a disclaimer form (Form-D) to exempt liability for refrigeration failure or electricity issues. The primary issue was whether the service provider failed to maintain the required temperature and whether the burden of proof for such maintenance lies with the consumer or the provider. The court reasoned that the onus to prove that the temperature of the cold store was maintained correctly lies with the service provider, as a negative fact (that temperature was not maintained) cannot be proved by the consumer. The court found that the provider failed to produce cogent evidence to prove temperature maintenance. As a consequence so flowing, appeal filed by the HAFED (F.A. No.14 of 2019) does not carry any substance and same is hereby dismissed. Appeal filed by complainant (F.A. No. 980 of 2019) is accordingly dismissed.
