Financial institutions cannot impose excessive or unconscionable default interest rates in loan contracts. Upon full settlement of dues calculated according to regulatory guidelines, creditors are legally obligated to issue a clearance certificate and return all original documents, as withholding them constitutes a deficiency in service.

Headnote:(A) Consumer Protection Act, 2019 - Section 40 - Scope of appellate review - Deficiency in service - Excessive interest rate - Appellate commission holds that power to review order is limited by statutory provisions and must be exercised in presence of relevant parties - An agreement imposing a 60% default interest rate is considered excessive and inconsistent with financial regulations. (Paras 10, 17, 18)

(B) Financial Contracts - Loan Agreement - Calculation of dues - Principles of natural justice apply where a consumer has fulfilled loan obligations in excess of the original agreement - Financial service providers must issue No Objection Certificates and return original documents upon satisfaction of dues calculated according to permissible rates, rather than arbitrary penalty rates. (Paras 16, 18)

Facts of the case:
The complainants entered into a home loan agreement. Despite paying total installments exceeding the originally agreed amount, the financial service provider withheld the clearance certificate and original property documents. The provider claimed substantial overdue penalties based on a 60% default interest rate. The lower consumer commission originally permitted part of the claims, leading to an appeal regarding the calculations of interest and entitlement to property documents.

Findings of Court:
The court observed that the financial institution had collected amounts exceeding the debt schedule and that the 60% default interest rate was unconscionable. The court mandated a recalculation of the outstanding balance based on permissible regulatory interest rates (original interest + 2% penalty). Upon payment of the recalculated amount, the institution is obligated to release the property documents.

Issues: Whether the classification of late payment charges and compound interest in a loan contract constitutes a deficiency in service, and whether the appellate authority can rectify the account settlement without remanding the matter to the lower commission.

Ratio Decidendi: Financial institutions cannot indefinitely withhold property documents or demand excessive penalty interest that violates regulatory guidelines. While courts should not rewrite contracts, they have the duty to prevent the exploitation of consumers through unconscionable contract terms, ensuring that account settlement is based on fair and legally permissible interest rates.

Result: Appeal partially allowed. Impugned order modified with directions for interest recalculation and release of collateral documents.

निर्णय

[द्वारा माननीय श्री मुकेश, सदस्य (न्यायिक)]

अपीलार्थी/विपक्षी मेंटोर इंडिया लिमिटेड ने प्रत्यर्थीगण/परिवादीगण श्री राहुल शर्मा एवं अन्य के विरुद्ध यह अपील विद्वान जिला उपभोक्ता विवाद प्रतितोष आयोग, जयपुर प्रथम, जयपुर (जिसे आगे सुविधा की दृष्टि से विद्वान जिला उपभोक्ता आयोग कहा जायेगा) के द्वारा परिवाद प्रकरण संख्या 184/2021 – श्री राहुल शर्मा एवं अन्य बनाम मेंटोर इंडिया लिमिटेड में पारित निर्णय दिनांक 14.02.2025 के विरुद्ध प्रस्तुत की है, जिसके द्वारा उन्होंने

प्रत्यर्थीगण/परिवादीगण का परिवाद विरुद्ध अपीलार्थी/विपक्षी स्वीकार कर निम्न आदेश पारित किया:-

"अतः परिवादीगण का परिवाद विरुद्ध विपक्षी आंशिक रूप से स्वीकार किया जाकर आदेश निम्न प्रकार से पारित किया जाता है कि:-

1. परिवादी से 61,000/- रूपये, जो अधिक लिये गये उस राशि में से अप्राथी को देरी से जमा किश्तों की राशि पर 02 प्रतिशत साधारण वार्षिक ब्याज की दर से ब्याज की गणना कर अर्थात् किश्त डयू होने की दिनांक से भुगतान तक की समयावधि पर 02 प्रतिशत साधारण वार्षिक ब्याज की दर से ब्याज की गणना कर जमा करने के बाद शेष राशि परिवादी को परिवाद दायर दिनांक से 09 प्रतिशत साधारण वार्षिक ब्याज की दर से अदा करें।

2. अप्राथी, परिवादी को शारीरिक और मानसिक वेदना की क्षतिपूर्ति हेतु 6,000/- रूपये (अक्षरे छह हजार रूपये) एवं परिवाद व्यय हेतु 5,000/- रूपये (अक्षरे पांच हजार रूपये) अदा करें।

3. अप्राथी को यह भी आदेशित किया जाता है कि उक्त वर्णित राशि निर्णय की तिथि से 45 दिवस में परिवादी को अदा करें।

4. परिवादी की शेष प्रार्थना अस्वीकार की जाती है।"

02. अपील से संबंधित परिवाद के तथ्य संक्षेप में इस प्रकार से है कि विपक्षी कंपनी एक फाइनेंस कंपनी है, जो अपने ग्राहकों को विभिन्न प्रकार के लोन मुहैया करवाती है। परिवादीगण ने विपक्षी कंपनी के यहां से दिनांक 17.02.2014 को अपने आवासीय घर प्लॉट नं. 19-20, श्रीकृष्ण विहार-V, पीथावास हाथोज, जयपुर के लिए सात लाख रूपये का होम लोन लिया था। परिवादीगण का होम लोन लिए जाने के सम्बन्ध में खाता संख्या एम.एच.एल. 1600 है। विपक्षी के द्वारा परिवादीगण को होम लोन स्वीकृत किये जाने के सम्बन्ध में स्वीकृति पत्र दिनांक 17.02.2017 को जारी किया गया, जिसमें होम लोन का भुगतान निर्धारित 84 किस्तों में किया जाना, तय किया गया था तथा प्रति किस्त की राशि 17,290/- प्रतिमाह तय किया गया। उक्त होम लोन पर आई.आर.आर. 24 प्रतिशत तय किया गया तथा डिफॉल्ट वार्षिक ब्याज दर 60 प्रतिशत तय किया गया एवं प्रति किस्त बाउन्स होने पर 1000/-रूपये चार्ज तय किया गया। विपक्षी के द्वारा होम लोन स्वीकृति से पूर्व 21,000/-रूपये नकद राशि जरिये रसीद मेंटोर ट्रस्ट के नाम से प्राप्त किये गये तथा एडवांस राशि किस्त के पेटे एक किस्त की राशि 17,290/-रूपये जरिये चेक प्राप्त किये गये। परिवादीगण द्वारा होम लोन प्राप्त किये जाने के पश्चात समस्त किस्तें समय-समय पर अदा की गयी। उक्त होम लोन के पेटे विपक्षी के द्वारा परिवादीगण से कुल राशि 14,52,360/-रूपये किस्तों में प्राप्त करना तय किया गया था। परिवादीगण के खाते से किस्त माह मार्च 2014 से प्रारम्भ हुई माह जनवरी 2015 तक चुकायी गयी एवं माह फरवरी 2015 की किस्त नकद जरिये रसीद संख्या 26693 जमा करवायी गयी अर्थात बैंक को कुल 11 किस्तों की कुल राशि 1,90,190/-रूपये एवं 17,290/-रूपये एडवांस कुल 2,07,480/-रूपये करवाने के बाद बकाया राशि 1452360-207480 = 1244880/-रूपये बची। परिवादीगण के खाते से माह मार्च 2015 से जुलाई 2015 तक किस्त का भुगतान नहीं किया जा सका था, जो कि 17290X5 = 86450/-रूपये हुए।

03. इसके बाद दिनांक 20.07.2015 को नकद राशि 24,000/-रूपये का भुगतान किया गया अर्थात 86450-24000 = 62450/-रूपये बकाया रहे, विपक्षी की लेनदारी 12,44,880/-रूपये में से 12,20,880/-रूपये रह गये तथा माह दिसम्बर 2016 में 40,000 रूपये का भुगतान आदर्श को-ऑपरेटिव बैंक लिमिटेड के करन्ट अकाउन्ट नम्बर 046014100000399 के चेक संख्या 070982 से किया गया, इसके बाद राशि रुपये 12,20,880-4,00,000 = 8,20,880/-रूपये शेष बची है। इसके बाद माह फरवरी 2017 से दिनांक 20.02.2018 तक किस्तों का भुगतान एक्सिस बैंक के खाता संख्या 0310101
