This appeal has been directed against the impugned judgment
and order dated 24.02.2021 passed by learned District Consumer
Disputes Redressal Commission, Rudraprayag (hereinafter to be

referred as “The District Commission”) in consumer complaint No. 04
of 2018, styled as Smt. Krishna Bahuguna Vs. Sh. Sukesh P. Bhave,
Deputy Vice President, Claim Health Corporate, SBI Life Insurance
Company Limited and another, wherein and whereby the consumer
complaint was allowed and the appellant – insurance company was
directed to pay to respondent No. 1 / complainant, the insured sum of
the insurance policy held by late Anand Swaroop Bahuguna, deceased
husband of respondent No. 1 / complainant, amounting to
Rs. 2,00,000/- together with interest @6% p.a. from the date of filing
of the consumer complaint till payment and Rs. 200/- towards litigation
expenses or to deposit the award amount before the District
Commission.
2. The facts giving rise to the present appeal, in brief, are, as such
that on 17.12.2016, during the course of his lifetime, late Anand
Swaroop Bahuguna, deceased husband of respondent No. 1 /
complainant, had obtained an insurance policy bearing
No. 0000000005471153 for insured sum of Rs. 2,00,000/-, which was
valid for the period from 17.12.2016 to 16.12.2017. Under the
aforesaid policy, the complainant was named as nominee. During the
subsistence of the insurance policy, the life assured died on cardiac
arrest (heart attack) on 02.07.2017, whereupon claim for the insured
sum under the policy, was submitted with the insurance company. The
insurance company issued two letters to the complainant for submission
of certain documents, which were submitted by the complainant with
the insurance company through letters dated 10.08.2017 and
09.10.2017 respectively, but the claim was not honoured by the
insurance company. The complainant through her Advocate sent a
legal notice dated 05.01.2018 to the insurance company, but still the

claim was not settled by the insurance company. Thus, alleging
deficiency in service on the part of the insurance company, consumer
complaint was set in motion by the complainant before the District
Commission.
3. The appellant / opposite party No. 1 (insurance company) filed
written statement before the District Commission and pleaded that the
deceased life assured died due to cardiac arrest on 02.07.2017, which
would be evident from his postmortem report. The policy obtained by
