STATE CONSUMER DISPUTES REDRESSAL COMMISSION
Devendra Kachhawaha, President
Life Insurance Corporation of India – Appellant
Versus
Habibunnisa – Respondent
Appeal No. 53/2024 | Appeal No. 54/2024
For the Appellants/Petitioners: Sanjay Mantri
For the Respondents: Narendra Pal Singh
Insurance contracts, being based on 'utmost good faith', require full disclosure of material health facts upon policy revival. Suppression of pre-existing ailments justifies claim repudiation, though the court may order a refund of premiums if total fraud in the contract's inception is not established.
Headnote:(A) Consumer Protection Act, 2019 - Insurance Claim - Suppression of material facts - Reinstatement of lapsed policy - Disclosure of pre-existing medical conditions - The principle of 'uberrima fides' (utmost good faith) governs insurance contracts. Failure to disclose material facts regarding health and medical treatments undergone prior to the revival of a lapsed policy constitutes a breach of the contract terms. Where a policyholder suppresses info regarding critical ailments and prior medical investigations, the insurer is justified in denying the full claim amount. However, if the lower commission directs the refund of paid premiums with interest due to the partial legitimacy of the contract's renewal, such orders are deemed legally sound in the absence of evidence proving the policy was obtained by total fraud. (Paras 4, 9, 10, 11)
Facts of the case:
The spouse of the complainant obtained a life insurance policy which subsequently lapsed due to non-payment of premiums. The policy was later revived following a personal declaration by the insured. Upon the death of the insured, the nominee filed a claim. The insurer rejected the claim on the grounds that the insured suppressed material information regarding pre-existing kidney ailments and prior hospital treatments at the time of policy revival. The lower commission awarded a refund of the total premiums paid along with interest, leading to cross-appeals by both the insurer and the complainant.
Findings of Court:
The court observed that the insured had indeed failed to disclose medical history and investigation results regarding his ailment at the time of the policy revival. Since insurance contracts are based on the principle of utmost good faith, the court found the lower commission's decision to order a refund of premiums with interest to be a balanced approach rather than granting the full death benefit, keeping in view the evidence of suppression.
Issues: The main issues were whether the insurer was justified in repudiating the claim due to the suppression of material facts and whether the order of the lower commission awarding partial relief (refund of premiums) was legally sustainable.
Ratio Decidendi: The court affirmed that insurance is a contract of 'utmost good faith' and any suppression of material facts regarding health status at the time of policy revival invalidates the full claim; however, in the absence of evidence of absolute fraud, the refund of premiums with interest as directed by the lower commission constitutes a just and equitable order.
Result: Appeals dismissed; the order of the lower commission stands confirmed.
