For the appellant : Mr.Manthan Pathania, Advocate For the respondent : None SIMARJOT KAUR, MEMBER The Appellant/Complainant-Darshan Singh has filed the present Appeal under Section 41 of the Consumer Protection Act, 2019 (in short ‘The Act’) to challenge the impugned order dated 30.01.2025 passed by the District Consumer Disputes Redressal Commission, Moga (in short ‘the District Commission’) whereby the Complaint filed by the Complainant was disposed off

2. It would be apposite to mention that hereinafter the parties will be referred, as have been arrayed before the District Commission. 3. Briefly, the facts of the case as made out in the Complaint before the District Commission are that the Complainant had approached the OP on 08.07.2024 to buy Air Tickets for trip to London for himself and for his wife Mrs.Sarbjit Kaur. The OP had booked a combined flight ticket for both the Complainant as well as his wife. It was booked from Guru Ram Dass International Airport Amritsar to IGI Airport Delhi and from IGI Airport Delhi to Heathrow Airport London. It was a roundup flight (to & from). The OP had booked the departure flight on 17.07.2024. The Complainant had paid an amount of Rs.1,40,000/- for said ticket. He had alleged that he was issued tourist visa for England through the OP and its commencement date was w.e.f. 18.07.2024. Whereas the OP had wrongly booked his ticket which was to depart on 17.07.2024. The OP was well aware that the visa of Complainant and his wife was valid from 18.07.2024 still it had booked them on a wrong flight. As told by the OP the flight was available for 17.07.2024, therefore, he had booked the Complainant for said flight for 17.07.2024. When the complainant and his wife went to Amritsar Airport to board the flight, they were not allowed to do so. The Airport Staff informed them that they could not board the flight before the commencement of visa. The Complainant immediately contacted the OP and brought to his notice about the wrong booking done by it. The Complainant was told by the OP that refund was not possible. Though the OP had booked another ticket for Complainant and his wife for 18.07.2024. It was a one way ticket. The OP had charged him an amount of Rs.70,000/- for the new ticket. The Complainant had to accept the new ticket as there was no option left with him. The Complainant had to pay double the amount due to fault on the part of the OP. The Complainant had also alleged that the OP did not advise him properly as to what documents he was supposed to carry to get foreign exchange in U.K. i.e. PAN card etc. Due to this, the Complainant had to face harassment at Amritsar Airport as well as Delhi Airport. Thereafter, the Complainant returned to India on 18.09.2024 and had approached the OP for refund of his amount paid for the ticket. But the OP had refused to do so. Hence, the Complaint was filed by the Complainant with prayer to issue directions to the OP :-
