Under the Pradhan Mantri Fasal Bima Yojna, the nodal bank or society is solely liable for any misreporting of farmer's land details on the portal and must compensate the farmer for any resulting loss in insurance claims, exonerating the insurance company.

Headnote:Under the Pradhan Mantri Fasal Bima Yojna, the complainant sought additional crop insurance compensation, alleging that the insurance company registered the land in the wrong Tehsil, resulting in underpayment. The District Commission held both the society and the insurance company jointly and severally liable for the deficiency in service. The primary issue was whether the insurance company or the nodal bank/society is liable for misreporting land details on the portal. The court reasoned that per the PMFBY guidelines, specifically Clauses XVII(2) and XXIV, the nodal bank or society is solely responsible for any substantial misreporting of farmer coverage and must make good all such losses. Accordingly, we modify the impugned order and direct the opposite party no.1-society to pay additional amount of compensation towards loss of crop on the basis of correct information/details of the complainant’s land within a period of two months.
