Under the Pradhan Mantri Fasal Bima Yojna, if a nodal bank uploads incorrect farmer or land details on the portal leading to wrongful insurance coverage or underpayment, the bank alone is liable to compensate the farmer for the resulting loss.

Headnote:The case involves claims for crop insurance compensation under the Pradhan Mantri Fasal Bima Yojna for the year 2017. The complainants, who are agriculturists, alleged that they received significantly lower compensation than entitled because the nodal bank uploaded incorrect land details (wrong Tehsil) on the insurance portal. The District Commission had previously held both the bank and the insurance company jointly and severally liable for the deficiency in service. The primary issue was whether the insurance company could be held liable for underpayment when the error originated from the bank's data entry on the portal. The court analyzed the PMFBY guidelines, specifically Clause XVII (2) and Clause XXIV, which stipulate that in cases of substantial misreporting by the nodal bank, the concerned bank alone shall be liable for such misreporting and its consequences. Accordingly, the court modified the impugned order, ruling that the bank alone is liable to compensate the complainants for the difference in insurance amount, along with the costs and interest awarded by the District Commission. The appeals stand partly allowed.
