Under the Pradhan Mantri Fasal Bima Yojna, the nodal bank is solely liable for any financial loss or underpayment of insurance claims resulting from the bank's misreporting of farmer details (such as village or tehsil) on the insurance portal.

Headnote:The matter pertains to the Pradhan Mantri Fasal Bima Yojna regarding the underpayment of crop insurance compensation. The complainant alleged that despite having land in Tehsil-Bagli, the insurance company paid compensation based on the loss in Tehsil-Tonkkhurd, resulting in a significant shortfall. The District Commission had previously held both the nodal bank and the insurance company jointly and severally liable for the deficiency in service. The primary issue is whether the insurance company is liable for underpayment when the nodal bank uploads incorrect location data on the insurance portal. The court reasoned that under Clause XVII(2) and Clause XXIV of the PMFBY guidelines, the nodal bank is solely responsible for any misreporting of farmer coverage and the resulting consequences, and must make good all such losses. Accordingly, we modify the impugned order and direct the opposite party no.1-bank to pay additional amount of compensation towards loss of crop on the basis of correct information/details of the complainant’s land within a period of two months.
