Under the Pradhan Mantri Fasal Bima Yojna, the nodal bank or society is solely liable for any losses resulting from misreporting farmer details on the portal, and the insurance company cannot be held responsible for such errors.

Headnote:The case involves claims for crop loss compensation under the Pradhan Mantri Fasal Bima Yojna. The complainants' insurance premiums were deducted by a society and forwarded to the insurance company; however, the society uploaded incorrect village information on the portal, leading to the insurance company's refusal to pay compensation. The District Commission had initially held both the society and the insurance company jointly and severally liable for the deficiency in service. The primary issue was whether the insurance company could be held liable for non-payment when the failure was due to incorrect data entry by the nodal bank/society. The court reasoned that according to the PMFBY guidelines, specifically Clause XVII(2) and Clause XXIV, the nodal bank or society is solely responsible for any misreporting of farmer coverage and the resulting consequences, and must make good all such losses. Accordingly, the impugned order was modified, and the aforesaid appeals stand partly allowed.
