PRESIDENT This Appeal is filed U/S 15 of the Consumer Protection Act, 1986 by Complainants challenging the Order dated 14.09.2015 passed in Consumer Complaint I No,699/2014 by the Bengaluru Urban Additional District Consumer Disputes Redressal Commission, Bengaluru (in short, the Dlstrict Commission).

2 Appellant No,1 and 2 were the Complainants and Respondent No.1 and 2 were the Opposite Parties No'1 and 2 (in short OPs) before the District Commission. For the sake of convenience, the rank of the parties shall be referred to as per their status before the District

Commission.

The brief facts of the case are that; the Complainants are employees of M/s Hewlett Packard, Bengaluru. They approached M/s SAF Infrastructure, a partnership firm engaged in real estate development and booked a in residential apartment bearing No.307 SAF Tejas Bloomingdale, Pai Layout, Bengaluru for total consideration of Rs.30,00,340/'. They paid an advance amount of Rs.1,00,000/- on 19.10.2011, Rs.4,00,000/- and Rs.5,00,000/- on 06.01.2012 by way cheques drawn at Vijaya Bank and Canara Bank in favour of OPs.

3(a). The Complainants were in need of Rs'15 lakhs to pay balance of sale consideration and arranged an additional amount of Rs.5,00,340/- themselves. The OPs had pre-approved the project of M/s SAF Infrastructure.

^l92s Upon verification of the documents, OPs have sanctioned the loan of Rs.15,00,000/- on 2L.02.2012 after collecting processing charges of Rs.8,2731-.

3(b). On the

16.02.20t2, Complainants have received an e-mail from the OPs confirming sanction of loan. On 20.03.20L2, when the Complainants approached the OPs regarding further formalities, they were informed that the said flat was already been sold to one Mrs. Vinaya Yashwant Rao and expressed their inability to disburse the loan to the Complainants stating that the loan was

The Complainants later came to know that OPs had processed the loan in favour of Mrs. Vinaya Yashwant Rao by relying on documents obtained earlier' The Complainants have approached OPs prior to Mrs., processed in favour of Mrs. Vinaya Yashwant Rao. Yashwant Rao and have completed all the formalities. The act of OPs in denying to releasing the loan caused the Complainants in huge loss.

The Complainants have filed a suit against the

Builder M/s SAF Infrastructure and Mrs. Vinaya Yashwant Rao ln O.S No.25822/20L2 before the Additional City Civil Judge, Mayo Hall, Bengaluru. Hence, pleading deficiency in service and sought compensation of Rs.15,00,000/-

from the OPs.
