In insurance disputes, where a surveyor's report is not effectively rebutted by evidence, it remains the standard for assessment. A complainant who rejects a reasonable settlement offer is not entitled to interest or additional damages for mental agony.

Headnote:(A) Consumer Protection Act - Insurance Claim - Settlement of claim - Limitation of appellate court - Evaluation of surveyor reports - When a complainant challenges a surveyor report but fails to lead evidence to substantiate claims or rebut the report, the surveyor's assessment holds weight. (Paras 10, 15)

(B) Appeals - Scope of interference - Where an insurer offers a settlement amount and the complainant refuses it, the insurer is bound by its own offer, but the complainant is not entitled to interest on that amount if they initially declined it. (Para 14)

(C) Evidence - Burden of proof - A party cannot claim higher compensation in a complaint than supported by evidence, and raising claims without evidentiary support or consistent with the initial surveyor-assessed claim reflects a lack of bona fides. (Para 15)

Facts of the case:
The complainant sought insurance coverage for damage caused to goods in a warehouse due to flooding. The surveyor assessed the loss at a specific value, which the insurer offered as a full and final settlement. The complainant rejected the offer, claiming a higher amount for the loss. The trial forum awarded 50% of the claimed amount. The insurer appealed, arguing that the surveyor's report was not challenged with evidence, there were contradictions in the complainant's pleadings, and no interest or compensation for mental agony should be awarded as the complainant had rejected the initial settlement offer.

Findings of Court:
The court found that the complainant provided no evidence to support claims higher than those assessed by the surveyor and failed to successfully challenge the surveyor's report. The court held that the insurer was bound by its initial settlement offer but was not liable to pay interest because the complainant had initially refused it. The award for mental agony and legal costs was set aside as the settlement offer was deemed reasonable.

Issues: Whether the complainant is entitled to compensation higher than the surveyor's assessment, and whether the complainant is entitled to interest and additional compensation for mental agony after rejecting a valid settlement offer.

Ratio Decidendi: An appellate court will not deviate from a surveyor's report unless the complainant provides concrete evidence to challenge it. If a complainant rejects a bona fide settlement offer, they are not entitled to claim interest on the settled amount, nor are they entitled to compensation for mental agony if the initial offer was fair and reasonable.

Result: Appeal allowed in part; order modified to restrict compensation to the surveyor-assessed value without interest, mental agony, or legal costs.
