sc/2e/A/88/2023

For the Appellants/Petitioners: Shivakumar.M.V
For the Respondents: K.A.Patil, Vignesh Shetty

Insurance claims for loan-protection policies should not be repudiated on narrow technical grounds if the insured suffers permanent total disability and loss of earning capacity, as this defeats the primary object of safeguarding the loan liability.

Headnote:The dispute involves a claim under a UNIHOME CARE INSURANCE POLICY regarding a housing loan of Rs. 15,00,000/-. The insured suffered a severe accidental fall resulting in 75% disability and post-traumatic paralysis, rendering him bedridden and unable to earn. The insurance company repudiated the claim based on Section-II exclusions, contending the policy only covered risks resulting in death. The central issue is whether permanent total disability and loss of earning capacity, resulting from an accident, qualify for a claim under a policy designed to safeguard loan liabilities, despite a clause emphasizing death within twelve months. The court reasoned that since the borrower is permanently disabled and incapable of discharging loan obligations, rejecting the claim on technical grounds would defeat the object of the insurance. The appeal is dismissed. The impugned order dated 16.09.2022 passed by the Dakshina Kannada District Consumer Disputes Redressal Commission, Mangalore in CC.No.239/2019 is confirmed.
