EA No.41 OF 2019|CC No.33 OF 2013

For the Respondents:

An execution application may be closed if the petitioner fails to prosecute the matter or follow up on the execution of warrants, provided liberty is granted to file a fresh application.

Headnote:The petitioners filed an application under Section 27 of the Consumer Protection Act, 1986, seeking the execution of an order dated 31.05.2019 passed in CC No.33 of 2013. The petitioners prayed for the recovery of Rs. 41,04,581/- with 9% interest per annum and the punishment of the respondents for non-compliance with the court's order. The court examined whether the execution application could proceed in light of the petitioners' absence and the pending status of Non-Bailable Warrants against the respondents. The court observed that the petitioners were not evincing interest in prosecuting the matter or following up with the police for the execution of the warrants. As the petitioner is not evincing any interest to prosecute the matter and to follow up with the police for execution of NBWs, the EA is closed granting liberty to the petitioner to file a fresh application as and when necessary.
