FIRST APPEAL NO. SC/9/A/1063/2024 | APPEAL NO. 1063 OF 2024
For the Appellants/Petitioners: Avinash Sharma
For the Respondents: Prasoon Kumar Rai
An appeal may be disposed of by the court when parties reach an amicable settlement, provided the terms are verified and agreed upon by both parties, with a provision for revival if the settlement terms are breached.
Headnote:The matter involves an appeal before the State Consumer Disputes Redressal Commission where the parties have reached an amicable settlement for a sum of Rs. 9,00,000/-. The court finds that a compromise agreement, duly signed by the learned counsel for both parties, has been filed and verified. The primary issue is whether the appeal can be disposed of in light of the settlement terms. The court reasoned that since the parties have jointly prayed for the disposal of the appeal based on the terms and conditions of the compromise dated 12-06-2026, the appeal deserves to be decided accordingly. The respondent shall pay Rs.9,00,000/- to the appellant within stipulated period as mentioned in compromise dated 12-06-2026.
