For the Respondents: Abhishek Goyal

An appellate consumer commission may dispose of an appeal and order the refund of statutory pre-deposits when the parties have voluntarily entered into a settlement agreement to resolve the dispute.

Headnote:The matter involves an appeal against an order of the District Consumer Disputes Redressal Commission, Faridabad. The parties entered into a Settlement Agreement dated 18.05.2026 for the resolution of the dispute and the refund of the pre-deposit amount. The court noted that the settlement was arrived at by both parties out of their free volition. The primary issue was whether the appeal could be disposed of in light of the voluntary settlement and the subsequent request for the release of the statutory deposit. The court reasoned that since the parties had settled the matter and the appellant no longer wished to pursue the appeal, the proceedings should be terminated in accordance with the settlement terms. The present appeal stands disposes off in terms of settlement arrived at between both the parties.
