Headnote:(A) Telecom Regulatory Authority of India Act - Subscription agreements - Petitioner, a Multi System Operator, filed multiple petitions for recovery against cable operators for outstanding subscription fees. Procedural status noted as respondents failed to appear resulting in ex parte orders. (Paras 1-3)

(B) Unchallenged Depositions - The evidence of the authorized signatory presented, proved documents such as subscription agreements and invoices. The testimony remained unchallenged, thus accepted as credible. (Paras 5-9)

Facts of the case:
Petitioner filed 28 petitions to recover dues for services rendered under subscription agreements with various local cable operators which were defaulted from September 2011 onward. Dues were claimed with applicable interest.

Findings of Court:
The court accepted the petitioner's claims based on the single key witness and granted favorable decrees for the sums claimed across all petitions.

Issues: The main issues addressed included the verification of claims based on the unchallenged deposition of the petitioner's witness and the validity of subscription agreements.

Ratio Decidendi: The court recognized the unchallenged evidence of the petitioner’s witness as compelling and ruled in favor of the petitioner based on documented claims for subscriptions rendered.

Result: All petitions allowed with decrees issued for the claimed amounts.

ORDER

M/s Kal Cable Pvt. Ltd., the petitioner, is a multi-system operator, operating in Coimbatore district of Tamil Nadu. It has filed this batch of 28 petitions, each against a cable operator from whom the petitioner seeks recovery of different sums of money as dues of monthly subscription fees. None of the 28 cable operators, respondents in this batch of petitions, appeared despite service of notice. Hence, all the petitions in the batch were proceeded with ex parte .

As all the 28 cases are based on similar facts, with the exception of the amounts of money claimed and, in a few cases the date of disconnection of signals, all the 28 petitions were heard together and are being disposed of by this common order.
