ORDER

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure, 1973 (for short ‘ Cr.P.C .’) to quash the proceedings against the petitioner in C.C.No.1697 of 2022, on the file of the learned II Additional Junior Civil Judge-cum-Judicial Magistrate of First Class (Juvenile Court), Bhupalapally, registered for the offences punishable under Section 420 of the Indian Penal Code, 1860 .

2. The brief facts of the case are that respondent No.2, Assistant Commissioner of Police, Kataram Police Station received a memo vide C.No.138/CI-DCRB-JSB/2017, dated 24.10.2017, in which it is mentioned that “sub: Register the case against the petitioner – Reg, Ref: C.No.A1/05/05/2016, dated 18.10.2017 of Commissioner of Police, Karimnagar with reference of the above cited subject that the petitioner has submitted fake caste certificate as Gandla – BC but he belongs to Reddy Gandla (OC).”

3. Basing on the said complaint, the Police registered a case against the petitioner in Crime No.263 of 2017 for the offences punishable under Section 420 of the IPC and after completion of investigation, they filed charge sheet, the same was numbered as C.C.No.1697 of 2022 before the learned II
