Award dated 18.10.2006 in I.D.No. 41 of 2004 on the file of the Labour Court, Warangal is in question in this Writ Petition by the Corporation.
2. The case of the Corporation is that the 2 nd respondent was appointed as badili conductor on daily wage basis w.e.f. 17.6.1987 and his services were regularized w.e.f.
1.12.1990. On 05.06.2002, while he was conducting service on route Yellandu (JK colony) at stage No.8/9, a check was exercised and he was booked for cash and ticket irregularities.
Basing on preliminary enquiry report and other material evidence, charge sheet dated 26.6.2002 was framed and after completing all formalities, he was imposed a minor penalty of deferment of annual increment for two years without cumulative effect vide proceedings dated 24.12.2002. It is stated, the 2 nd respondent, without exhausting statutory remedies such as appeal and review, straight away moved conciliation machinery, and as conciliation failed, a report was sent to Government by the Conciliation Authority. The government referred the dispute to Industrial Tribunal-cum-Labour Court for adjudication.
It is stated that the Industrial Tribunal-cum-Labour Court had taken the matter in I.D.No.
