JUDGMENT: 

Aggrieved by the judgment dated 15.03.2007 (hereinafter will be referred as ‘impugned judgment’) passed by the learned Additional Metropolitan Sessions Judge for the trial of Jubilee Hills Car Bomb Blast Case – cum – Additional Family Court – cum – XXIII Additional Chief Judge, Hyderabad (hereinafter will be referred as ‘Tribunal”) in O.P.No.2221 of 2003, the insurance company/respondent No.2 has filed the present Appeal to set aside the judgment.

2. For the sake of convenience, the parties hereinafter be referred as they were arrayed before the Tribunal.

3. The brief facts of the case as can be seen from the record are that the petitioners have filed claim petition claiming compensation of Rs.5,00,000/- from the respondent Nos.1 and 2 for the death of deceased by name “Shanker” (hereinafter will be referred as ‘deceased’). Petitioner No.1 is the wife and petitioner Nos.2 to 4 are the children of deceased and petitioner No.1. The reason assigned by the petitioners for the death of the deceased is that on 03.09.2003 while the husband of the petitioner No.1 was traveling in Auto Rickshaw bearing No.AP 28 V 1948 from Secunderabad to New Market Yard, the driver of the auto drov
