ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner, seeking the following relief:
“….to issue a Writ of Mandamus or any other appropriate writ order declaring the action of respondent Nos.2 and 3 in allowing the request of the 4th Respondent to change its name from Arun Jyothi Enterprises Ltd to Naolin Enterprises Ltd which is identical to the Petitioners name Naolin Capital Services Pvt Ltd as illegal, arbitrary and contrary to Sections 20 and 22 of the Indian Companies Act, 1956 and thereby direct respondent Nos.2 and 3 not to permit respondent No.4 to change its name to M/s. Naolin Enterprises Ltd.…”
2. The petitioner is a company initially incorporated with the word ‘PRN’, but the same was subsequently replaced by the word ‘NAOLIN’, which was approved by the Central Government on 05.06.2012 and the company ‘PRN Infrastructure Private Limited’ was allowed to be changed to ‘M/s.Naolin Capital Services Limited’ on 19.06.2013 and accordingly, fresh certificates of incorporation were issued.
