HIGH COURT OF TELANGANA
P.SREE SUDHA, J
Md. jahangeer Ali – Appellant
Versus
The Election Officer – Respondent

ORDER:

This Civil Revision Petition is filed against the orders of the trial Court dated 20.02.2023 passed in I.A.No.821 of 2021 in O.OP.No.45 of 2021, on the file of XI Additional Chief Judge, City Civil Court, Hyderabad.

2. An application is filed before the trial Court for Ad- interim injunction against respondent Nos.1 to 3 and it was dismissed by the trial Court and aggrieved by the said order, this Civil Revision Petition is preferred.

3. It is mainly contended by learned counsel for the petitioner that the order passed by the Court below is cryptic and without taking into consideration the documents filed by the petitioner which clearly shows that the respondent No.2 was not eligible to contest the elections as per the by-laws of the society. An O.P is filed under Telangana Societies Registration Act, 2001, and the association shall be governed by the by-laws of the society and any deviation therefrom cannot be allowed. It was also contended that the trial Court dismissed the application on the ground that the appellant did not raise any objection at the time of election. In fact, he raised objection before commencement of the elections as per the copy of letter dated 28.08.20
