THE HON’BLE SRI JUSTICE PULLA KARTHIK WRIT PETITION No.36993 OF 2024

O R D E R:

With the consent of both the parties, this Writ Petition is taken up for disposal, at the admission stage.

2. This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of the respondents in not releasing and paying the Gratuity (TS) amount of Rs.6,15,827/- with Token No.2520892536, dated 26.07.2024, Gratuity (Composite State) amount of Rs.7,25,776/- with Token No.2520892527, dated 26.07.2024, Commutation of pension (TS) of Rs.5,90,576/- with Token No.2520892510, dated 26.07.2024 and Commutation of pension (CS) Rs.6,96,017/- with Token No.2520892498, dated 26.07.2024, General Provident Fund of Rs.10,92,825/- with Cheque/Token No.2517542133, dated 05.07.2024 and Encashment of Earned Leave (Final) of Rs.5,43,766/- with Token No.2520893839, dated 26.07.2024, even after finalising the bill and having generated in Comprehensive Financial Management System (CFMS), inspite of repeated requests as illegal, arbitrary, unreasonable and violative of Articles 14, 16 and 21 of the Constitution of India and consequently, direct the respondents to release and pay the said amounts along with interest @ 24 per annum.

3. Heard Sri Ugender Reddy, learned counsel for the petitioner; learned Government Pleader for Services-III for respondent Nos.1 to 4; learned Government Pleader for Services-I for respondent No.5.

4. Learned counsel for the petitioner submits that the petitioner retired from services in the capacity of School Assistant (Physical Science) on 30.06.2024 on attaining the age of superannuation. The petitioner has submitted his pension proposals to the respondents for sanction of pension. Considering the same, the Principal Accountant General, Telangana, vide letter, dated 04.06.2024, sanctioned the retirement benefits to the petitioner. Thereafter, respondent Nos.2 to 5, being the Drawing and Disbursement Officer, processed the bills for release of retirement benefits viz., Gratuity (TS) amount of Rs.6,15,827/- with Token No.2520892536, dated 26.07.2024, Gratuity (Composite State) amount of Rs.7,25,776/- with Token No.2520892527, dated 26.07.2024, Commutation of pension (TS) of Rs.5,90,576/- with Token No.2520892510, dated 26.07.2024, Commutation of pension (CS) Rs.6,96,017/- with Token No.2520892498, dated 26.07.2024, General Provident Fund of Rs.10,92,825/- with Cheque/Token No.2517542133, dated 05.07.2024 and Encashment of Earned Leave of Rs.5,43,766/- with Token No.2520893839, dated 26.07.2024. However, inspite of lapse of six months from the date of retirement and even after issuing token numbers, respondent No.1 has not released the admitted bills. Therefore, learned counsel prays this Court to direct the respondents to release retirement benefits to the petitioner pursuant to letter, dated 04.06.2024, issued by the Principal Accountant General, Telangana.

5. Learned Government Pleader for the respondents submits that in pursuance of letter, dated 04.06.2024, the respondents will release the retirement benefits to the petitioner. However, prays this Court to grant twelve weeks time in this regard.

Having regard to the submissions made by learned counsel for the respective parties, this Writ Petition is disposed of directing the respondents to release retirement benefits to the petitioner in pursuance of Letter No.AG (A&E) /P15/II/S-218/SP136/2024-05/722, dated 04.06.2024, issued by the Principal Accountant General, Telangana, as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order.

There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
