COMMON ORDER:

Crl.P.No.379 of 2024 is filed by the petitioner/accused to quash the proceedings against him in STC.NI.No.4121 of 2022 on the file of VIII Metropolitan Magistrate, Hyderabad.

Crl.P.No.2139 of 2024 is filed by the petitioner/accused to quash the proceedings against him in STC.NI.No.1844 of 2023 on the file of VIII Metropolitan Magistrate, Hyderabad. The offences alleged against both the petitioners are under Section 138 r/w. Section 142 of Negotiable Instruments Act, 1881 (for short ‘N.I.Act’).

2. The facts of the case are that the 2 nd respondent is a registered Co-operative Urban Bank Ltd., represented by its Assistant Manager. The object and aim of the 2 nd respondent- Bank is to serve the public by accepting the deposits and granting loans. Petitioners herein along with others have approached the 2 nd respondent for obtaining loan of Rs.1,75,00,000/- to meet their needs. The 2 nd respondent sanctioned the said amount and as a part payment, petitioner in Crl.P.No.379 of 2024 issued cheque bearing No. 221312 for an amount of Rs.6,26,888/- and cheque bearing No.354386 for an amount of Rs.9,00,000/- respectively drawn on State Bank of India, Old Malakpet Branch and promis
