JUDGMENT:

This first civil appeal has been filed by the unsuccessful plaintiffs in O.S.No.84 of 1998 on the file of I Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar filed under Section 96 of Code of Civil Procedure (for short ‘CPC’) and challenge is against the Judgment, dated 22.04.2002 whereunder their suit filed by the appellants has been dismissed by the trial Court.

As could be seen from the averments made in the plaint in the above referred suit, the appellants have filed the said suit with a prayer to declare the Judgment and Decree, dated 10.11.1989 in O.S.No.154 of 1988 on the file of Principal Subordinate Judge, Ranga Reddy District as void and un-executable with a consequential perpetual injunction to restrain the defendants therein from interfering with their possession over the suit property. It appears from the record, O.S.No.154 of 1988 has been filed by defendant Nos.13 to 23 with a prayer for specific performance of an agreement in respect of land in Sy.No.494/1 of Mancherevula Village, Rajendranagar Mandal, said to have been sold in their favour by the original owner by name Hyder Ali Mirza.
