ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Stamps and Registration appearing for the respondents. With their consent, this writ petition is disposed of at the stage of admission itself.

2. This writ petition is filed seeking the following prayer:

“to declare the action of the 3rd Respondent in not completing the Digital signature of registered sale deed No.128/2024 dated 25.01.2024 which is already registered by him presented by the petitioner on 25.01.2024, vide Application No.2400045946 in respect of the land in Sy No.71/14 to an extent of Ac.1.30 gts situated at Pothireddypally village, Sanga Reddy Mandal, Sanga Reddy District as illegal arbitrary and in violation of the Telangana Rights in Land and Pattadar Pass Books Act, 2020 and consequently direct the 3rd respondent to do Digital signature of registered sale deed No.128/2024, dated 24.01.2024 which is already registered by him and pass such other order or orders .”

Learned counsel for the petitioner submits that petitioner vendor’s father i.e., Shaik Baban was the original possessor of the land in Sy No.71/14 to an extent of Ac.1-30 gts, situated at Pothireddipally Village, Sangareddy Mandal, Sangareddy District (herein after referred as ‘subject land’), vide proceeding No.D2 No.D2/14367/1967, dated 15.02.1968, under Loani Rules 9(g) of Laoni Rules 1950. Thereafter, petitioner vendor’s father name was mutated in the Revenue records in the year 1967 and also granted patta respectively. Subsequently, petitioner’s vendor inherited the subject land as successor and has been in possession and enjoyment of the subject land and the name of the petitioner’s vendor was mutated in the revenue records and pattadar passbooks were also issued by the competent authorities.

Learned counsel for the petitioner further submits that petitioner’s vendor and other filed WP No.27926 of 2023 seeking to change the subject land and other lands from assigned land to patta land by considering the TM- 33 module of Dharani Portal and also remove from the list of prohibited properties in Dharani Portal maintained under Section 22-A of the Registration, Act, 1908 and the Hon’ble Court disposed of the WP No.27926 of 2023 on 06.10.2023 with a direction to respondent authorities therein to consider the petitioners therein application and pass orders. Subsequently, District Collector, Sangareddy considered and issued proceeding No.D/2300104780/2023, dated nil-10-023, which reads as:

“In view of the above facts and recommendations of the Tahsildar, Sangareddy Mandal and Revenue Divisional officer, Sangareddy Division, the request of the applicant for change of land classification from Konugolu to Pouthi/Varasathvam/Anuvamshikam in Sy No.71/14 to an extent of Ac.1-30 gts, situated at Pothireddy Village of Sangareddy Mandal besides removing from the list of Prohibited properties

maintained U/s.22-A of Registration Act, 1908 is hereby approved.”

Learned counsel for the petitioner further submits that petitioner thereafter submitted online application through Dharani portal before the respondent No.3 for registration of subject land, vide Application No.2400045946, dated 25.01.2024 and also paid stamp duty and registration fees and booked a slot. Thereafter, Dharani operator captured Vendor, Vendee witness details and biometric & Photograph and forwarded the same to respondent No.3 for verification of biometric authentication and assigned Document No.128/2024, dated 25.01.2024. However, the respondent No.3 is not completing the Digital Signature in Dharnai Portal and in the online application status, it is showing that “Registration Application No.240045946 is pending at Tahsildar & Jt.Sub Registrar office for Digital Signing” and submits that respondent No.3 in not completing the Digital signature of registration which is illegal, arbitrary and violation of the Telangana Rights in Land and Pattadar Passbook Act, 2020 and pray this Court to direct the resp
