Since the issue involved in both the appeals is one and the same, they are being heard together and disposed of by way of this common judgment.

2. Aggrieved by the judgment and decree dated 23.03.2007 passed in O.S.No.53 of 2004 by the IX Additional Chief Judge (Fast Track Court) City Civil Court, Hyderabad, C.C.C.A.No.157 of 2007 is filed by the appellants-defendants 5 & 6, who are subsequent purchasers of the suit schedule property and C.C.C.A.No.210 of 2007 is filed by the appellants-defendants 1 to 3.

3. Heard Sri P.Giri Krishna and Sri S.Ram Reddy, learned counsel appearing for the appellants, Sri E.Madan Mohan Rao, Sri D.Jagan Mohan Reddy and Sri S.Ram Reddy, learned counsel appearing for the respondents 1 to 3.

4. For the sake of convenience, the facts in C.C.C.A.No.210 of 2007 are discussed hereunder.

5. It is the case of the appellants that the 1st respondent- plaintiff has filed O.S.No.53 of 2004 for specific performance of an agreement of sale dated 06.01.2001 alleged to have been executed by P.Hanuman Prasad, who is one of the partners of S.V.Constructions.
