O R D E R:

This Criminal Petition is filed by the petitioner/Accused, seeking to quash proceedings in C.C.No.3550 of 2021, on the file of I Additional Junior Civil Judge-Cum-XII Additional Judicial Magistrate of First Class, R.R.District at Rajendranagar.

2. Heard learned counsel for the petitioner/Accused and Sri M.Vivekananda Reddy, learned Assistant Public Prosecutor for the respondent – State. Perused the record.

3. The 2nd respondent, who was working as a Police Constable at RGI Airport Police Station, found during patrolling duty that there was a drinking water godown. The petitioner was preparing water bottles with ‘Kinley’ label without permission, making purchasers believe they were original ‘Kinley’ company water bottles. On enquiry at the godown, it was found that the person present at the premises was the petitioner.

4. Accordingly, on the basis of the 2nd respondent’s finding of water bottles of water with the label ‘Kinley’, a charge sheet was filed against this petitioner under Sections 188 and 420 of IPC.

5. Insofar as Section 188 of IPC is concerned, it reads as under:-
